Toy and Gifting Safety: What Every Parent (and Santa!) Should Know This Holiday Season

CD Law wants to remind parents, grandparents, friends, and even Santa Claus of the importance of being mindful of your gifting choices this holiday season. Holiday gifting is all fun and magic until a toy turns out to be unsafe. With new products hitting shelves daily and online marketplaces full of third-party sellers, staying aware of recalls and age-appropriate toys is essential to keeping kids safe during this season, and year round.

The Consumer Product Safety Commission’s 2023 Toy Report reveals just how common toy-related injuries are:

  • 154,700 children 12 and under were treated in emergency rooms due to toy-related injuries
  • 10 children died from toy-related incidents

These numbers are a powerful reminder that staying alert to hazards isn’t being overprotective.

Be Careful With Recalls

Before wrapping that shiny new toy, take a moment to check whether the product has been recalled. Recalls don’t always make headlines, and unsafe items can still appear in stores, especially at secondhand shops.

The CreateOn Crayola-branded Pip-Cubes were recently recalled after it was discovered that magnets inside the cubes can become loose if the seams separate. When swallowed, these high-powered magnets can attract to each other inside the body, causing life-threatening injuries such as intestinal perforations, twisting, blockages, blood poisoning, and in the most severe cases, death.

Recall Date: December 4, 2025
Units Affected: About 9,400

Christmas’s Most Common Toxic or Unsafe Gifts

  • Toys with small detachable pieces which are a major choking hazard
  • Magnetic toys with high-powered magnets
  • Counterfeit or knockoff products with untested materials
  • Cheaply made electronics that can overheat or spark
  • Cosmetic or craft kits with unregulated ingredients
  • Imported items from unverified sellers, especially via online marketplaces. Trusted retailers follow U.S. safety standards. Third-party sellers often don’t.

CPSC Holiday Safety Tips Every Gifter Should Know

The Consumer Product Safety Commission (CPSC) provides simple guidelines to ensure holiday gifting stays joyful and safe:

  • Follow age guidelines and choose toys that fit the child’s abilities and interests
  • Give safety gear like helmets for scooters and ride-on toys and make sure kids use it
  • Avoid small parts for children under 3
  • Look for choking-hazard labels on packaging or company websites
  • Throw away packaging immediately as plastic wrap and ties are unexpected hazards

Remember: Recalled items can show up in thrift stores and secondhand shops
